Agreement to Terms

By downloading, installing, or using the WhaleTrack mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

Description of Service

WhaleTrack is a mobile application that:

  • - Monitors blockchain transactions for specified wallet addresses
  • - Provides real-time alerts for large cryptocurrency transactions ("whale transactions")
  • - Displays transaction data from public blockchain networks
  • - Sends push notifications about relevant transactions
  • - Offers both free and premium subscription plans with different features and limitations

Account Registration

Account Creation

  • - You must create an account using a valid email address to use certain features of the App
  • - You are responsible for maintaining the confidentiality of your account credentials
  • - You must provide accurate and complete information when creating an account
  • - You must be at least 13 years old to create an account

Account Security

  • - You are responsible for all activities that occur under your account
  • - You must notify us immediately of any unauthorized use of your account
  • - We are not liable for any loss or damage arising from unauthorized access to your account

User Responsibilities

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

  • - Use the App for any illegal or unauthorized purpose
  • - Attempt to gain unauthorized access to our systems or other users accounts
  • - Interfere with or disrupt the App's functionality
  • - Use the App to monitor wallets without proper authorization
  • - Violate any applicable laws or regulations
  • - Share your account credentials with others
  • - Create multiple accounts to circumvent subscription limitations

Account Security

  • - You are responsible for maintaining the security of your device and account credentials
  • - You are responsible for all activities that occur under your account
  • - You must notify us immediately of any unauthorized use
  • - You must use a strong, unique password for your account

Subscriptions and Payments

Subscription Plans

  • - Free Plan: Limited features including up to 3 whale wallets and 2 custom wallets
  • - Premium Plan: Unlimited whale wallets and custom wallets, plus additional features
  • - Subscription plans are billed monthly through Apple App Store or Google Play Store
  • - Subscription prices are displayed in the App and may vary by region

Free Trial

  • - We may offer a free trial period for premium subscriptions
  • - Free trial terms will be clearly displayed before you subscribe
  • - If you don't cancel before the trial ends, you will be charged for the subscription

Auto-Renewal

  • - Subscriptions automatically renew at the end of each billing period
  • - You will be charged the subscription fee unless you cancel before the renewal date
  • - Renewal charges occur automatically through your Apple App Store or Google Play Store account

Cancellation

  • - You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings
  • - Cancellation takes effect at the end of the current billing period
  • - You will continue to have access to premium features until the end of the current billing period
  • - No refunds are provided for the current billing period after cancellation

Refunds

  • - Refund requests must be submitted through Apple App Store or Google Play Store
  • - Refund eligibility is determined by Apple or Google's refund policies
  • - We do not process refunds directly
  • - If you receive a refund, your subscription will be cancelled and premium features will be disabled

Price Changes

  • - We reserve the right to change subscription prices at any time
  • - Price changes will not affect your current subscription period
  • - You will be notified of price changes before your next renewal
  • - Continued use after a price change constitutes acceptance of the new price

Subscription Limitations

  • - Free plan users are limited to 3 whale wallets and 2 custom wallets
  • - Premium users have unlimited wallets
  • - We reserve the right to modify subscription features and limitations at any time
  • - Changes to subscription features will be communicated to users

Intellectual Property Rights

Our Rights

  • - The App and its original content, features, and functionality are owned by WhaleTrack
  • - All trademarks, service marks, and trade names are proprietary to WhaleTrack
  • - The App is protected by copyright, trademark, and other intellectual property laws

Your Rights

  • - You retain ownership of any wallet addresses you provide
  • - You grant us a license to use your data as described in our Privacy Policy

Data and Privacy

  • - Your use of the App is also governed by our Privacy Policy
  • - We collect and process data as described in our Privacy Policy
  • - You consent to the collection and use of your information as outlined in our Privacy Policy

Disclaimers and Limitations

No Financial Advice

  • - The App is for informational purposes only
  • - We do not provide financial, investment, or trading advice
  • - All transaction data is for informational purposes only
  • - You should not rely on this information for making financial decisions

Service Availability

  • - We do not guarantee uninterrupted access to the App
  • - The App may be temporarily unavailable due to maintenance or technical issues
  • - We reserve the right to modify or discontinue the service at any time

Accuracy of Information

  • - We strive to provide accurate information but cannot guarantee its accuracy
  • - Blockchain data is sourced from public networks and may contain errors
  • - You should verify all information independently

Limitation of Liability

To the maximum extent permitted by law:

  • - We shall not be liable for any indirect, incidental, special, or consequential damages
  • - Our total liability shall not exceed the amount you paid for subscriptions in the 12 months preceding the claim
  • - We are not responsible for any losses resulting from your use of the App
  • - We are not responsible for any investment decisions made based on App data
  • - We are not responsible for any issues with payment processing through Apple App Store or Google Play Store
  • - We are not responsible for subscription billing disputes, which must be resolved through Apple or Google

Indemnification

You agree to indemnify and hold harmless WhaleTrack from any claims, damages, or expenses arising from:

  • - Your use of the App
  • - Your violation of these Terms
  • - Your violation of any third-party rights
  • - Any content you submit through the App

Termination

By You

  • - You may stop using the App at any time
  • - You may delete the App from your device

By Us

  • - We may terminate or suspend your access to the App at any time
  • - We may discontinue the App or any part of it at any time
  • - Termination does not affect any provisions that should survive termination

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kyrgyz Republic, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

  • - Binding arbitration if negotiations fail
  • - The courts of Kyrgyz Republic as a last resort

Changes to Terms
